# 用户使用协议（Terms of Service）
## 1. 协议的接受和生效

欢迎使用「此刻心」应用（以下简称「本应用」）。本用户使用协议（以下简称「本协议」）是您与本应用开发者之间关于使用本应用的法律协议。
请您在使用本应用前仔细阅读并理解本协议的所有条款。一旦您下载、安装、注册或使用本应用，即表示您已充分理解并同意接受本协议的全部内容，本协议即对您产生法律约束力。如果您不同意本协议的任何条款，您应立即停止下载、安装、注册或使用本应用。
本协议可能会根据法律、法规的变更或业务调整等因素进行修订，修订后的协议将在本应用内公布并立即生效。您继续使用本应用即视为您接受修订后的协议。

Welcome to use the "Page of Destiny" application (hereinafter referred to as "this Application"). This Terms of Service (hereinafter referred to as "this Agreement") is a legal agreement between you and the developer of this Application regarding the use of this Application.
Please read and understand all terms of this Agreement carefully before using this Application. Once you download, install, register or use this Application, it means that you have fully understood and agreed to accept all contents of this Agreement, and this Agreement shall have legal binding force on you. If you do not agree to any terms of this Agreement, you shall immediately stop downloading, installing, registering or using this Application.
This Agreement may be revised according to changes in laws and regulations or business adjustments. The revised Agreement will be published in this Application and take effect immediately. Your continued use of this Application shall be deemed as your acceptance of the revised Agreement.

2.2 您应当保证所提供的注册信息真实、准确、完整，并且在信息发生变更时及时更新。如果您提供的信息不真实或不完整，本应用有权拒绝为您提供服务或终止您对本应用的使用。
2.3 您应当妥善保管您的账户和密码，对您账户下的所有活动和行为负责。如果您发现您的账户被非法使用或存在安全漏洞，应当立即通知本应用。
2.4 本应用有权根据法律法规的要求或为了维护本应用的正常运行，对您的账户进行管理，包括但不限于冻结、注销账户等。

2.1 When using this Application, you can use basic functions without registering an account. However, some advanced functions may require you to register or log in to an account.
2.2 You shall ensure that the registration information you provide is true, accurate and complete, and update it in a timely manner when the information changes. If the information you provide is untrue or incomplete, this Application has the right to refuse to provide services to you or terminate your use of this Application.
2.3 You shall properly keep your account and password, and be responsible for all activities and behaviors under your account. If you find that your account is illegally used or there are security vulnerabilities, you shall immediately notify this Application.
2.4 This Application has the right to manage your account according to the requirements of laws and regulations or to maintain the normal operation of this Application, including but not limited to freezing, canceling accounts, etc.

3.1 您可以在本应用上记录和管理您的个人日记、便签，使用情绪追踪功能，获取答案之书的启发内容。
3.2 您应当合法、合规地使用本应用，不得利用本应用进行任何违法、违规或违反公序良俗的活动，包括但不限于：
- 发布、传播违法、淫秽、暴力、恐怖、侮辱、诽谤等内容；
- 侵犯他人的知识产权、隐私权、名誉权等合法权益；
- 干扰本应用的正常运行，破坏本应用的技术防护措施；
- 利用本应用进行欺诈、钓鱼等非法活动；
- 其他违反法律法规或本协议的行为。
3.3 您应当对您在本应用上发布的所有内容负责，确保其不违反法律法规和本协议的规定。
3.4 本应用有权对您的使用行为进行监督和管理，对于违反本协议的行为，本应用有权采取相应的措施，包括但不限于删除内容、限制功能、冻结账户、终止服务等。

3.1 You can record and manage your personal diary and notes, use mood tracking functions, and obtain inspirational content from the Answer Book on this Application.
3.2 You shall use this Application legally and compliantly, and shall not use this Application for any illegal, irregular or unethical activities, including but not limited to:
- Publishing or disseminating illegal, obscene, violent, terror, insulting, defamatory and other content;
- Infringing on others' intellectual property rights, privacy rights, reputation rights and other legitimate rights and interests;
- Interfering with the normal operation of this Application and destroying the technical protection measures of this Application;
- Using this Application for fraud, phishing and other illegal activities;
- Other behaviors that violate laws and regulations or this Agreement.
3.3 You shall be responsible for all content you publish on this Application, and ensure that it does not violate laws, regulations and the provisions of this Agreement.
3.4 This Application has the right to supervise and manage your use behavior. For behaviors that violate this Agreement, this Application has the right to take corresponding measures, including but not limited to deleting content, restricting functions, freezing accounts, terminating services, etc.
## 4. 知识产权

4.1 本应用的所有内容，包括但不限于文字、图片、音频、视频、软件、源代码、商标、标识等，均受知识产权法律法规的保护，归本应用开发者或相关权利人所有。
4.2 您在使用本应用时，仅获得本应用的使用权，不得对本应用的任何内容进行复制、修改、传播、销售、出租、反向工程、分解或试图获取源代码等行为，除非获得本应用开发者的书面授权。
4.3 您在本应用上发布的内容，其知识产权归您所有，但您授予本应用开发者非独家、全球性、免费、可再授权、不可撤销的许可，允许本应用开发者在本应用及其相关服务中使用、复制、修改、传播、展示该内容。
4.4 您应当保证您对发布的内容享有合法的知识产权，不会侵犯任何第三方的合法权益。否则，您应当承担由此产生的一切法律责任。

4.1 All contents of this Application, including but not limited to text, pictures, audio, video, software, source code, trademarks, logos, etc., are protected by intellectual property laws and regulations, and belong to the developer of this Application or related right holders.
4.2 When using this Application, you only obtain the right to use this Application, and shall not copy, modify, spread, sell, rent, reverse engineer, decompose or attempt to obtain source code of any content of this Application, unless you obtain written authorization from the developer of this Application.
4.3 The intellectual property rights of the content you publish on this Application belong to you, but you grant the developer of this Application a non-exclusive, global, free, sublicensable, irrevocable license to use, copy, modify, spread and display the content in this Application and its related services.
4.4 You shall ensure that you have legal intellectual property rights to the published content, and will not infringe any legitimate rights and interests of any third party. Otherwise, you shall bear all legal responsibilities arising therefrom.

5.1 This Application attaches great importance to your privacy protection and strictly complies with relevant laws and regulations. The privacy policy of this Application will detail how this Application collects, uses, stores and protects your personal information.
5.2 This Application mainly saves your data through local storage, including but not limited to diaries, notes, mood records, etc. These data are only stored on your device and will not be automatically uploaded to the server.
5.3 This Application may collect some non-personally identifiable information, such as device model, operating system version, application usage, etc., to improve the performance and user experience of this Application.

## 6. 付费服务和订阅

6.1 本应用提供免费和付费两种服务模式。付费服务包括月度会员、年度会员和永久会员。
6.2 您可以通过本应用内的购买渠道购买付费服务。购买成功后，您将获得相应的服务权限。
6.3 月度会员和年度会员为自动续订服务。在订阅期限届满前24小时内，系统将自动从您的支付账户中扣除相应费用，以延长订阅期限。您可以随时在设备的设置中关闭自动续订功能。
6.4 永久会员为一次性购买，购买后终身有效，无需续订。
6.5 所有付费服务一经购买，概不退款，除非法律另有规定或本应用开发者另有决定。
6.6 如果您违反本协议的规定，本应用开发者有权取消您的付费服务资格，且不退还任何费用。

6.1 This Application provides both free and paid service modes. Paid services include monthly membership, annual membership and lifetime membership.
6.2 You can purchase paid services through the purchase channels in this Application. After successful purchase, you will obtain corresponding service permissions.
6.3 Monthly membership and annual membership are auto-renewable services. Within 24 hours before the expiration of the subscription period, the system will automatically deduct the corresponding fees from your payment account to extend the subscription period. You can turn off the auto-renewal function in the device settings at any time.
6.4 Lifetime membership is a one-time purchase, which is valid for life after purchase and does not need to be renewed.
6.5 All paid services are non-refundable once purchased, unless otherwise provided by law or determined by the developer of this Application.
6.6 If you violate the provisions of this Agreement, the developer of this Application has the right to cancel your paid service qualification without refunding any fees.
## 7. 终止和暂停

7.1 您可以随时停止使用本应用，无需通知本应用开发者。
7.2 本应用开发者有权根据法律法规的要求或为了维护本应用的正常运行，随时暂停或终止为您提供服务，包括但不限于：
- 您违反本协议的规定；
- 您的行为可能对本应用或其他用户造成损害；
- 法律、法规或政府部门的要求；
- 本应用进行维护、升级或调整；
- 其他不可抗力因素。
7.3 服务终止后，本应用开发者将不再为您提供任何服务，但您仍需对您在服务终止前的行为承担责任。
7.4 服务终止后，本应用开发者有权保留或删除您的相关数据，具体处理方式将根据隐私政策的规定执行。

7.1 You can stop using this Application at any time without notifying the developer of this Application.
7.2 The developer of this Application has the right to suspend or terminate the services provided to you at any time according to the requirements of laws and regulations or to maintain the normal operation of this Application, including but not limited to:
- You violate the provisions of this Agreement;
- Your behavior may cause damage to this Application or other users;
- Requirements of laws, regulations or government departments;
- Maintenance, upgrade or adjustment of this Application;
- Other force majeure factors.
7.3 After the termination of services, the developer of this Application will no longer provide any services to you, but you still need to bear responsibility for your behaviors before the termination of services.
7.4 After the termination of services, the developer of this Application has the right to retain or delete your related data, and the specific processing method will be implemented according to the provisions of the privacy policy.

## 9. 法律适用和争议解决

9.1 本协议的订立、履行、解释及争议解决均适用中华人民共和国法律（不包括香港特别行政区、澳门特别行政区和台湾地区的法律）。
9.2 对于因本协议的订立、履行或解释而产生的任何争议，双方应首先通过友好协商解决。如果协商不成，任何一方均有权向有管辖权的人民法院提起诉讼。

9.1 The formation, performance, interpretation and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China (excluding the laws of the Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan Region).
9.2 Any dispute arising from the formation, performance or interpretation of this Agreement shall first be resolved through friendly negotiation between both parties. If the negotiation fails, either party has the right to file a lawsuit with a people's court with jurisdiction.

10.2 本协议的任何条款被认定为无效或不可执行，不影响其他条款的效力。
10.3 本应用开发者未行使或延迟行使本协议项下的任何权利，不构成对该权利的放弃。
10.4 本协议构成双方之间关于使用本应用的完整协议，取代之前的所有口头或书面协议。
### English Version
10.1 The title of this Agreement is only set for convenient reading and does not affect the interpretation and effect of this Agreement.
10.2 If any clause of this Agreement is deemed invalid or unenforceable, it shall not affect the validity of other clauses.
10.3 The failure of the developer of this Application to exercise or delay in exercising any right under this Agreement shall not constitute a waiver of such right.
10.4 This Agreement constitutes the complete agreement between both parties regarding the use of this Application, replacing all previous oral or written agreements.
